Terms and Conditions of Use
1. ACCEPTANCE
These Terms and Conditions ("Agreement") govern the access to and use of the website(www.taskies.ca) and the Taskies mobile application (available on Android and iOS platforms), owned and operated by Jasman Inc. (“Taskies”), with its registered office located at Montreal.
By accessing or using our Services, you agree to be legally bound by these Terms, establishing a contractual relationship between you and Taskies.
If you do not agree to these Terms, you may not access or use the Services.
Taskies may terminate these Terms or cease offering access to the Services at any time, for any reason.
The Mobile Application is intended primarily for residents of Canada. Users accessing the Service from other countries do so at their own risk and are responsible for compliance with local laws.
We may update these Terms at any time. Updates will be communicated through reasonable means, including posting the revised Terms on our website.
Continued use of the Services after changes constitutes acceptance of the revised Terms.
2. SERVICES
Taskies provides a technology platform allowing users to connect with independent wellness professionals ("Taskers") offering at-home services such as massage therapy and beauty treatments.
All services are performed exclusively by third-party providers. Taskers are not employees, agents, or representatives of Taskies.
Vetting of Taskers
Taskies conducts a basic screening of Taskers, which may include interviews and, where applicable, verification of professional qualifications or certifications required for the specific services offered.
While Taskies strives to ensure the quality and professionalism of Taskers, Taskies does not guarantee the accuracy, completeness, or validity of any Tasker's qualifications or credentials.
Taskers remain independent contractors solely responsible for their services.
3. USER REQUIREMENTS
The Services are offered to users who can legally enter into binding contracts.
Minors are not permitted to use the Services.
4. LICENSE
Subject to compliance with these Terms, Taskies grants you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use the Mobile Application on your personal device solely for your use of the Services.
- Access and use any related content and materials for personal, non-commercial use.
All materials, including images, text, logos, designs, videos, and code, are the exclusive property of Taskies and protected under Canadian and international copyright and trademark laws.
You may not reproduce, modify, distribute, or create derivative works from the Content without Taskies' prior written consent.
5. PAYMENT, CANCELLATIONS, AND REFUNDS
All payments are processed securely through Stripe. Charges are made in Canadian Dollars (CAD) and include applicable GST and QST.
a) Cancellation by the Tasker
- If the Tasker cancels more than 24 hours before the appointment, the Client may rebook with another Tasker at no additional cost or receive a full refund.
- If the Tasker cancels less than 24 hours before the appointment, the Client will automatically receive a full refund and be invited to book another Tasker without additional cost.
b) Cancellation by the Client
- If the Client cancels more than 24 hours before the appointment, they will receive a full refund, minus a 5% processing fee.
- If the Client cancels less than 24 hours before the appointment, a 50% cancellation fee will apply; the remaining 50% will be refunded.
- If the Client cancels after the Tasker has arrived at the service location, no refund will be issued.
c) No-Show
- If the Client is absent or unavailable at the scheduled time, the service will be considered completed, and no refund will be issued.
6. INFORMATION PROVIDED BY USERS
By providing information through the platform, Users acknowledge Taskies is a passive platform connecting Clients with Taskers.
Taskies does not supervise, direct, or control Taskers.
Taskies reserves the right to remove, block, or refuse any User information that is deemed inappropriate.
7. USER OBLIGATIONS
Users must:
- Use the platform appropriately.
- Respect intellectual property rights.
- Maintain confidentiality of account credentials.
- Refrain from fraudulent, harmful, or unlawful activities.
- Book services solely for themselves.
8. ACCOUNT SECURITY
Users are responsible for safeguarding their account credentials and must promptly notify Taskies of any unauthorized use.
9. EXCLUSION OF LIABILITY
To the maximum extent permitted by law, Taskies is not responsible for:
- The quality, safety, legality, or outcome of services performed by Taskers.
- Any personal injuries, including but not limited to physical injury, illness, emotional distress, or death, arising from or related to the services provided by Taskers.
- Any property damage, including but not limited to loss, theft, or destruction of personal belongings, arising during or after the provision of services by Taskers.
- Any damages, losses, or expenses (whether direct, indirect, incidental, special, consequential, or punitive) arising out of or related to:
- The actions or omissions of Taskers;
- User interactions with Taskers outside of the Taskies platform;
- Agreements or payments made independently between Clients and Taskers, outside the Taskies platform.
- Taskers' compliance with local licensing, insurance, or certification requirements.
- Any misinformation, misrepresentations, or errors in the Tasker's profiles, qualifications, or service descriptions.
- Any delays, cancellations, or failure by Taskers to perform the agreed-upon services. / Force majeure events (e.g., natural disasters, pandemics, government actions, labor disputes, technical failures) that may affect the provision of services.
Taskers operate as independent contractors and are solely responsible for the services they offer. Taskies does not supervise, monitor, or control the work of Taskers, nor does it guarantee the quality or outcome of any service booked through the platform. Clients are solely responsible for evaluating the suitability of any Tasker they choose to engage.
10. PERSONAL DATA PROTECTION
Taskies is committed to protecting your personal information in compliance with PIPEDA and Quebec's Law 25.
Collected information may include: name, email, address, phone number, date of birth, and service history.
This information is used to:
- Provide services.
- Maintain account records.
- Communicate promotions and service updates.
- Ensure platform security.
11. LANGUAGE CLAUSE
The Terms and Conditions are available in both English and French.
In case of any discrepancy, the French version shall prevail.
12. JURISDICTION
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada.
Any disputes shall be submitted to the courts of Montreal, Quebec, Canada
13. FINAL AGREEMENT
By using Taskies' Mobile Application or Website, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
